1. INTRODUCTION AND ACCEPTANCE
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and LoanPe Intelligent Solutions Private Limited (“Company”, “we”, “us”, or “our”). By accessing our platform, website, or mobile application, you agree to be bound by these Terms and our Privacy Policy.
2. ELIGIBILITY
By using this platform, you represent and warrant that:
You are at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872.
All information provided during registration or application is accurate, complete, and current.
You are a resident of India.
3. SCOPE OF SERVICES
Advisory Role: The Company acts as a digital marketplace and referral partner that connects customers with regulated lending partners (Banks/NBFCs).
No Lending: The Company is not a lender and does not directly provide loans. Loan approvals, interest rates, and terms are determined solely at the discretion of the partner financial institutions.
Service Range: Our services include advisory for Home Loans, Business Loans, Personal Loans, Loans Against Property, and Credit Cards.
4. USER COVENANTS AND AUTHORIZATIONS
Credit Information: You authorize the Company to fetch your credit score and credit information from bureaus (e.g., CIBIL, Experian) to assess your loan eligibility.
KYC Verification: You agree to provide necessary KYC documents as required by lending partners for the loan application process.
Communication: By submitting your details, you consent to be contacted via call, SMS, WhatsApp, or email regarding loan offers, even if you are registered under DND/NCPR.
5. FEES AND CHARGES
Advisory Fees: While the Company may provide advisory services, final loan-related fees (processing fees, documentation charges) are levied by the respective lending partner.
No Upfront Payment: The Company typically does not charge customers upfront fees for referral services unless explicitly stated in a separate agreement.
6. INTELLECTUAL PROPERTY
All content, logos, and technology on the platform are the exclusive property of LoanPe Intelligent Solutions Private Limited. Unauthorized use or reproduction is strictly prohibited.
7. LIMITATION OF LIABILITY
The Company shall not be liable for any losses arising from the rejection of a loan application by a financial partner.
We do not guarantee the accuracy of third-party information or the continuous availability of the platform.
8. INDEMNIFICATION
You agree to indemnify and hold harmless the Company and its directors from any claims, damages, or legal fees resulting from your violation of these Terms or your misuse of the platform.
9. TERMINATION
We reserve the right to suspend or terminate your access to the services immediately, without notice, for any breach of these Terms.
10. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
